DASK When Selling a Home: The New Rules for 2026

DASK When Selling a Home: The New Rules for 2026

New DASK rules affect what buyers and sellers need to arrange before a title transfer. This guide explains the policy checks and the seller’s refund process.

An important DASK regulation concerning real estate buying and selling transactions in Turkey has been published. With the regulation published in the Official Gazette dated August 21, 2026, and numbered 33347, the article titled “Change of Beneficiary” in the General Terms of Compulsory Earthquake Insurance has been amended.

The new regulation particularly concerns property owners selling their homes and individuals purchasing real estate.

Existing DASK Policy Will End When the Property is Sold

The most significant change in the regulation pertains to the status of the existing DASK policy after the sale transaction.

According to the new rule, if the insured property changes hands through a sale or similar transaction, the existing Compulsory Earthquake Insurance contract will terminate as of the registration date at the land registry.

In other words, the DASK policy issued in the seller's name will no longer automatically transfer to the new owner along with the property.

Therefore, the person purchasing the property will need to have a valid Compulsory Earthquake Insurance policy in their own name.

New Owner's DASK Policy Will Be Checked During Title Transactions

One of the most noteworthy sections of the regulation regarding real estate sales transactions is the control at the title deed stage.

Land registry offices or authorized administrative bodies will check whether there is a Compulsory Earthquake Insurance contract in the name of the new owner during the ownership change.

This change particularly requires individuals purchasing properties in Bodrum and Milas to plan their DASK policy more carefully in their preparations before the title deed transaction.

What Will Happen to the Seller's Unused DASK Premium?

The termination of the policy on the title registration date due to the sale of the property makes the remaining duration of the policy significant.

According to the new regulation, if the insured or the previous beneficiary applies, the paid premium corresponding to the unused days of the policy can be refunded to the insured.

For example, if the house is sold a few months before the annual DASK policy expires, the former owner can apply for a refund of the premium for the remaining period.

Policy Does Not End with Every Change of Ownership

There is an important distinction in the regulation.

While the policy ends with the title registration in ownership changes due to sales and similar transactions, it is possible for the contract to continue with the new beneficiary in other changes of beneficiary specified in the regulation.

In this case, the new beneficiary must notify the insurance company that intermediated the policy within 15 days from the date they learned of the change and the existing insurance contract.

The insurance company or its agent will be obliged to issue the amended policy containing the change of beneficiary to the new beneficiary within 24 hours after receiving the notification.

What Changes for Those Buying a House in Bodrum?

DASK was already one of the important documents in the title transfers of villas, apartments, or other properties for sale in Bodrum. The new regulation clarifies the responsibilities of the buyer and seller regarding the policy.

Especially in second-hand property sales, it is essential not to act on the assumption that “the house already has a DASK policy.” Since the seller's existing policy will terminate with the sale, it is crucial for the buyer to prepare their own policy before the title deed transaction.

As Turnkey Properties Real Estate and Investment Consultancy, we recommend that buyers and sellers in real estate sales transactions in Bodrum and Milas plan not only the property's price and title transfer but also the processes related to DASK, title costs, and other necessary documents before the sale.

When Did the New DASK Rules Take Effect?

The changes took effect on 5 September 2026. For sales registered on or after that date, the seller’s policy ends on the date of registration. Buyers need a valid policy in their own name. Sellers can apply to the insurer or agent for a refund of premiums covering unused days.

In Brief, the New DASK Application

  • The existing DASK policy belonging to the seller will terminate on the title registration date when the property is sold.
  • It will be checked during the title transaction whether there is a DASK policy in the name of the new owner.
  • The former owner can request a refund of the paid premiums for the unused period.
  • In some changes of beneficiary other than sales, the existing policy may continue.
  • In this case, the new beneficiary will need to notify within 15 days.
  • The insurance company or its agent will prepare the necessary amended policy within 24 hours after the notification.

DASK should not be seen merely as a formality to be completed on the title day in real estate transactions. Especially with the new regulation, preparing the correct policy in the buyer's name before the sale becomes increasingly important for the smooth progress of the title process.
